Niles Curfew

Unless accompanied by a responsible adult, children under the age of 17 must be home between 10:30 p.m. and 6 a.m. However, on Friday and Saturday, curfew begins at 11:30 p.m. Parents and teens should be aware that other communities may have curfew laws more restrictive than Niles. Exceptions to this law are as follows:

• If you were 17 years of age or younger you would be allowed out past curfew if you were accompanied by and supervised by a parent, legal guardian or other responsible companion who is at least 18 years of age and is approved of by the parent or legal guardian.
• Having a legal job that you have to travel to and from.
• Attending a constitutionally protected activity, attending or traveling to or from a religious, civic, educational, or political event or gathering.

A law enforcement officer may not detain a child or take a child into custody based on a violation of this section unless the law enforcement officer, after speaking with the child and considering the facts and surrounding circumstances, reasonably believes that:

• The child has violated this subsection
• There is no legal defense to the violation
